Terms of Use

These terms apply from the moment you install BoatMover and every time you use it. If you do not accept them, do not use the app.

The service is operated by Via Maris (“we”, “us”). You can reach us at boatmoverapp@gmail.com.

What BoatMover is.

BoatMover records rowing outings, turns them into a score, shows safety information while you are on the water, and makes both available to the club you row for. It is a training and club administration tool. It is not anything else, and nothing outside these terms is promised.

You are responsible for your own safety on the water.

You remain responsible at all times for the safe navigation of your boat, for your own decision to go out, and for obeying your club's rules, your governing body's rules and the navigation rules of the water you are on. BoatMover is not a lookout and is not a substitute for looking where you are going. Use your own judgement, and use the app at your own risk.

What the app shows you differs from what is actually there.

The map shows what your club drew on it and what your phone can work out from satellite positioning. Actual conditions on the water differ from it. It does not show other boats, swimmers, debris, wildlife, moored craft, a changed stream, or anything that has moved, appeared or disappeared since the map was drawn.

The warnings can fail, arrive late, or not arrive at all.

Sound depends on your phone's volume, its battery, its speaker and on nothing else taking the audio — a call or another app will silence a warning without telling you. Position depends on satellite reception. Detection depends on the phone staying where you put it and on the movement being one the app can recognise. Any of these can fail, and when they do the app says nothing.

Silence from BoatMover means nothing at all. It is never an all-clear, and you must never wait for a warning before acting on what you can see.

BoatMover is not an emergency service. No alert it sends, including any intended to summon help, is a substitute for calling one. If you or anybody else needs help, call the emergency services.

The score is an estimate, and it is yours to check before you act on it.

Scores, splits, distances, rates, rankings and comparisons are calculated from imperfect measurements and may be inaccurate, incomplete, delayed or misleading. Selection, training and crew decisions taken on them are yours, and you are responsible for reviewing a figure before you rely on it.

Physical risk is yours, and this is not medical advice.

Rowing and training carry a risk of injury, and you accept that risk. BoatMover is not a medical device and gives no medical advice; its heart-rate figures and thresholds are estimates, not clinical measurements. If you have any reason to be cautious about exercise, ask a doctor before you use it — and never delay or disregard medical advice because of something the app showed you.

What we collect, and your agreement to it.

By using BoatMover you agree that we collect and hold: your outings and what the phone records during them, including position, speed, timing and heart rate when you pair a strap; the personal details the score is calculated from — sex, age or date of birth, height and weight; your name and your identity on your club's roster; and anything you enter or upload yourself. If you do not agree to this, do not use the app.

What we do with it.

We use it to run the service, to show your club your rowing, and to develop, test, calibrate and improve BoatMover. We do not sell it and we do not give it to advertisers.

Your club sees your rowing.

BoatMover is a club app. The coaches and administrators of the club you sign in to can see your sessions, your scores and the personal details in clause 7. That is what the app is for.

The service is provided as it is, and we may change it.

We do not promise that BoatMover will be available, uninterrupted or free of faults, or that anything you record will be stored or delivered. Keep your own record of anything you cannot afford to lose. We may change, suspend or withdraw the app, any part of it, or your access to it. We use other companies' services to operate BoatMover and may change which ones, at any time, without notice.

Limitation of liability.

To the fullest extent the law allows, we are not liable for any loss, damage, injury or cost arising out of your use of BoatMover — including anything it showed you, anything it failed to show you, and any period in which it was unavailable or did not work.

Governing law.

These terms are governed by the law of Israel, and any dispute about them will be dealt with by the courts of Israel.

Changes to these terms, and how to reach us.

We may change these terms. The version and date at the top of this page change with them, and by continuing to use the app you accept the version then in force. Questions about any of this: boatmoverapp@gmail.com.
